Terms of Service

Last updated:July 22, 2026. These Terms of Service ("Terms") are an agreement between you and VCorp, operating DepthFeed ("DepthFeed," "we," or "us"). By creating an account, purchasing a subscription, or using the website, API, live streams, applications, or data, you agree to these Terms. If you use DepthFeed for an organization, you represent that you may bind that organization, and "you" includes it.

1. The service

DepthFeed provides metered access to recorded and live prediction-market information, related reference data, and analysis tools. Access is licensed, not sold, and is tied to your account, plan, API credentials, and the controls described in the documentation. Coverage, fields, source cadence, and available history differ by venue and series.

You are responsible for your account activity and for keeping credentials confidential. Notify us promptly if you suspect unauthorized access. You may create only the number of accounts and keys reasonably needed for your own authorized use.

2. Plans and access controls

Each plan defines a history window, asset and venue access, live-stream allowances, and metering controls. Published requests-per-second and requests-per-minute figures are general REST admission limits. They are not archive-delivery rates and do not mean every endpoint can run that many expensive queries at once.

Historical snapshots, batch requests containing historical reads, exports from analysis tools, and other resource-intensive operations may have separate account-level controls, including concurrency, query-start frequency, page size, time-range, compute, and rolling response-volume limits. These controls apply independently of the general REST limits. When a control is reached, a request may be queued, rejected with 429, or require a narrower query. Current behavior is described in the API documentation and, where exposed, account responses.

DepthFeed is a query-access subscription. A plan does not include a bulk, offline, object- storage, database-replication, or full-archive delivery right unless we expressly agree to it in a separate written order. We may use reasonable technical controls to prevent circumvention, protect source systems, preserve fair access, and enforce these Terms.

3. Isolated query capacity

A plan may assign designated DepthFeed workloads to an isolated query pool rather than the regular shared query pool. The Desk plan may use capacity shared with other Desk accounts; it is not account-exclusive or customer-owned infrastructure unless a separate written order expressly says otherwise. Isolated query capacity does not transfer ownership or administrative control of infrastructure, create an unrestricted archive-export right, or remove account, endpoint, history, safety, or acceptable-use controls.

Actual query completion depends on the requested range, depth, filters, response size, source layout, network conditions, and maintenance. Dedicated capacity does not include a minimum uptime, availability, latency, throughput, response-time, support-response, recovery-time, or error-rate commitment, and it does not create a right to service credits.

4. Permitted use

Subject to these Terms and your plan, we grant you a limited, non-exclusive, non-transferable, revocable right to query and use DepthFeed data for your internal research, analysis, model development, backtesting, and trading. You may retain reasonable query results and derived analytics needed for those activities. Derived results must not expose or permit reconstruction of substantial DepthFeed records.

5. Prohibited use

You must not, directly or through another person, account, key, or service:

  • systematically acquire, mirror, reconstruct, or maintain a substitute for a substantial portion of the DepthFeed archive or live feed;
  • sell, sublicense, publish, redistribute, or provide third-party access to raw or substantially similar data, including through a competing data product or API;
  • split traffic across accounts, keys, identities, IP addresses, or processes to evade concurrency, rate, history, response-volume, or other controls;
  • scrape undocumented surfaces, bypass access checks, probe for vulnerabilities, interfere with the service, or reverse engineer non-public systems;
  • use the service or data unlawfully, to violate third-party rights, or to misrepresent the source, completeness, or timeliness of the data; or
  • share credentials outside your organization or allow use by more people than your order permits.

Normal cursor pagination over a bounded research query is permitted. Repeated pagination or automation whose purpose or practical effect is archive replication is not. Contact us before building a use case that redistributes raw data or serves it to customers.

6. Data, trading, and third-party sources

Market and reference data can be delayed, incomplete, duplicated, corrected, unavailable, or affected by venue changes. Empty books and capture gaps can be genuine source conditions. You must validate data and trading logic independently. DepthFeed is not a broker, exchange, fiduciary, investment adviser, or execution venue, and nothing in the service is financial, legal, tax, or investment advice.

DepthFeed is independent and is not affiliated with or endorsed by Polymarket, Kalshi, Limitless, Binance, or any exchange. Third-party sources remain subject to their own rights and conditions. Portions of the historical archive include data from pmxt, used under the CC BY 4.0 license.

7. Billing and automatic renewal

Quant, Research, and Desk are monthly subscriptions. The price, billing interval, and any applicable taxes are shown before checkout. Unless you cancel, your subscription renews automatically at the start of each billing period and the payment method on file is charged. Prices are stated and charged in US dollars unless checkout says otherwise. Explorer requires no payment card.

Checkout and payment processing are provided by Stripe. DepthFeed is the seller of the subscription, and Stripe processes the payment and provides related billing services. Stripe's checkout terms and privacy notice also apply. We do not receive or store your full card number.

Research is the customer-facing name for the plan previously displayed as Desk Lite. This naming change does not change the base subscription's price, billing interval, included limits, history window, renewal, cancellation, or other commercial terms. Existing order and checkout records remain controlling records of what was purchased.

Paid plans may include a monthly quantity of AI execution credits. Monthly credits expire at the end of the applicable paid period. Additional credits are sold separately on a pay-as-you-go basis, do not expire unless required by law or disclosed before purchase, and are consumed at the model provider's cost plus the DepthFeed margin displayed before execution. AI credits pay only for model execution inside DepthFeed. They do not purchase, extend, or unlock data history, downloads, exports, API limits, live streams, venue access, or any other subscription entitlement.

Optional server-side research compute, if offered, is a separate add-on that is disabled by default. It does not apply to existing subscription usage and cannot be activated by continued use. It requires a separate affirmative acceptance that displays the metric, unit price, currency, monthly spend cap, and effective time. The add-on does not reduce or replace anything included in the base plan.

You authorize recurring charges until cancellation and are responsible for applicable taxes not collected at checkout. Failed or reversed payments may result in restricted or suspended access. You can manage the payment method, invoices, plan, and renewal from Manage billing when supported by the applicable processor.

8. Cancellation, plan changes, and refunds

You may cancel at any time from Manage billing. Cancellation stops future renewal and does not ordinarily end the paid period early; access continues until the displayed paid-through date and then returns to Explorer. We do not prorate or refund an unused portion of a billing period merely because you cancel or stop using the service.

An automatic refund of the most recent payment is available only when the paid plan has not been used: no successful billable API call has been made on that plan since the paid period began. Once a paid plan has been used, it is not eligible for an automatic or discretionary usage-based refund. Automatic refunds are limited to two in any rolling 90 days and trigger a 30-day wait before re-subscribing. An approved refund ends the associated paid access.

These rules do not limit non-waivable consumer rights or correction of a duplicate, unauthorized, or erroneous charge. If you believe a charge is incorrect, contact us promptly with the invoice and account details.

Paid upgrades may take effect immediately and may be prorated; downgrades ordinarily take effect at the next renewal. We may change future plan features or prices. A recurring price change applies no earlier than a future renewal after notice and an opportunity to cancel.

9. Suspension and termination

We may restrict, suspend, or terminate access when reasonably necessary to address a breach, non-payment, credential compromise, legal request, security risk, abusive automation, or harm to DepthFeed, its infrastructure, sources, or other customers. When practical, we will give notice and an opportunity to cure. We may act immediately where delay would increase risk. You may stop using the service at any time; subscription cancellation remains governed by Section 8.

10. Ownership

DepthFeed and its licensors retain all rights in the service, software, documentation, selection and arrangement of data, and branding. These Terms grant only the limited use rights stated above. If you provide feedback, you permit us to use it without restriction or compensation. You retain rights in your own code, strategies, and analytics, subject to our rights in underlying DepthFeed materials.

11. Disclaimers

To the maximum extent permitted by law, the service and data are provided "as is" and "as available." We disclaim all express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, uninterrupted access, and error-free operation. We do not warrant any trading result, live fill, queue position, profit, or suitability for a regulated or high-risk use.

12. Limitation of liability

To the maximum extent permitted by law, neither DepthFeed nor its suppliers will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, trading opportunities, data, goodwill, or business interruption, even if advised of the possibility. Our aggregate liability arising from the service or these Terms will not exceed the amount you paid to DepthFeed for the service during the three months before the event giving rise to the claim. These limits do not apply where prohibited by law.

13. Indemnity

If you use DepthFeed for a business, you will defend and indemnify DepthFeed and its personnel against third-party claims, damages, and reasonable costs arising from your unlawful use, prohibited redistribution, infringement of third-party rights, or material breach of these Terms. This does not require indemnification for our own fraud or willful misconduct.

14. Changes and general terms

We may update these Terms to reflect product, legal, security, or operational changes. We will post the revised date and give reasonable advance notice of material changes when required. Continued use after the effective date constitutes acceptance; if you do not agree, stop using the service and cancel before the next renewal.

These Terms, the Privacy Policy, the applicable checkout, and any written order form are the entire agreement for the service. A written order form controls only where it expressly conflicts with these Terms. You may not assign the agreement without our consent; we may assign it as part of a reorganization, financing, or sale. If a provision is unenforceable, the remainder stays effective. Failure to enforce a provision is not a waiver. Provisions that by nature should survive termination do survive, including use restrictions, ownership, disclaimers, liability limits, and payment obligations.
